1) Introduction
Concept of tourist package
The legislative decree nr 111/95 of March 17th 1995, concerning the fulfilment of the ECC directive 90/314, provides: The subjects of tourist packages are: holidays, journeys and all inclusive chains if they are combined with at least one of the following elements, sold for a price on a lump-sum bases, and which last more than 24 hours or for a period including at least 1 night:
a) Transport;
b) Lodging;
c) Non additional tourist services (omissis)... which are a significant part of the "tourist package".

2) Source of the law
The sale contract is regulated by the legislative decree n. 111 of 17 March 1995, the ECC Directive 94/314, of the international Convention concerning the tourist contract (CVV) signed in Brussels in the 20 April 1970, as well as by the law 29/12/1977 n. 1084 as for applies to the services of the tourist package, and of the expectation concerning the Civil Code and other rules of internal law, because they are not deviated from expectation of this contract.

3) Bookings
The booking request shall be written on a special form filled in every its part and underwrite by the client. The acceptance of the reservations is subordinated at the available of the structures and it is complete with consequent conclusion of the contract, only at the moment of the write confirmation by Serafino Viaggi. Travel Agency, holder of regular licence, could give to the client, as the art. 6 of the legislative decree n. 111/95, a copy of the contract only if it has already the confirm.

4) Payments
At the moment of reservation it shall be pay an account of 25% of the total amount with entrance-fee. The settlement must be paid at least 30 days before the departure. About reservation effected in the 30 days before the date of departure, you must pay the whole amount at the moment of reservation. A non-payment in the fixed date become a resolutive clause, included in the contract, which determines the cancellation, excepted the compensation for further damages suffered by Serafino Viaggi.

5) Validity of the price
Quotas could be modified until 20 days before the fixed departure date, because of variations during the exchanges, the carriers' rates and the costs of the tourist services. If the rise of the price goes beyond 10%, the participant is able to withdraw from the contract, as long as you give a write communication to Serafino Viaggi, within 2 workdays from the receiving of the communication about the rise of the price. Otherwise, the rise gives to understand that it is accepted. In case the rise is inferior of 10%, the client can't withdraw from travel contract. Also in this last case, Serafino Viaggi must communicate, within 20 days from the fixed departure date, the variation in a write communication by fax, telefax or telegram to travel agency which must inform the client and make up the amount.

6) Cancellations
If a participant, after the booking, might cancel the travel contract, he will be entitled to the refund of the paid sum, except entrance-quota and the following specified penalties:
- until 30 days before the beginning of the holiday: 10% of the entrance-quota;
- from 29 to 15 day before the beginning of the holiday: 30% of the price;
- from 14 to 7 days before the beginning of the holiday: 50% of the price;
- from 7 to 3 days before the beginning of the holiday: 75% of the price;
- cancellation 2 workdays before the departure (except saturday) or during the journey: 100% of price.
For cancellation of the air ticket or other transport services, it will be put into effect the articles of the single carrier.

7) Participants' obligations
Participants must be provided with a valid document and they must observe rules of prudence and diligence, and all information of the coordinator, as well as the regulations and administration or legal dispositions about the journey. Participants will answer for all damages, which the travel organization could undergo because of the participants' non-performance of the obligations.

8) Coordinator's responsibility
Coordinator don't answer for damages to the traveller if the event is caused by traveller or somebody outside the provide of the services foreseen in the contract, in case of chance, force majeure, or in any situations which the coordinator couldn't foreseen or settle, in accordance with professional diligence.

9) Claims and reports
Traveller shall report sending a letter, in the form of claim, to the coordinator, the differences and vices of the tourist package as well as the non-performances in its organization or realisation, in the moment when they happen or, if they are not immediately recognizable, within 10 working days from the foreseen return date to the departure town.
If client make a complaint in the place of carrying out of services included in the "all inclusive" tourist package, the coordinator have to assist traveller in order to find a quick and fair solution. Likewise, coordinator will provide even if the claim will be present at the end of the holiday, in any case it will guarantee a quickly reply at the traveller' requests.

10) Assurance against costs of cancellation
They who reserve are covered by an insurance for people, luggage and penalty for eventual cancellation. See the page "Ensure your journey".

11) Substitution of the carrier and hotels
Organization has the power to substitute carriers and hotels with others ones with similar characteristics, if this will be necessary because of operative or other causes.

12) Legal jurisdiction
For any controversy dependent on the present contract, FORO of Lecce will be competent.

13) Assurance
To guarantee the correct fulfilment of the obligations with the client, Serafino Viaggi has drawn up an insurance policy CEA N. 51641.

Italian legislation punish crime about prostitution and minor pornography with imprisonment penalty, even if crimes are committed in a foreign country.
